Disturbing the Peace

California Disturbing the Peace law can be charged as either a misdemeanor or infraction and is breached when someone:

  • 1. Unlawfully engages in fighting, challenging another person to fight, and is in a public place;
  • 2. Disturbs another person with loud and unreasonable noise; if this is done willfully and maliciously; and
  • 3. Using offensive words in a public place causing or provoking an immediate violent reaction.

Driving with a Suspended or Revoked License

California's Driving with a Suspended or Revoked License law is a misdemeanor, but the penalties may vary according the reason why your license was suspended, and how and why you were cited for violating your license suspension or revocation.

Driving with a suspended or revoked license occurs when:

  • 1. You drove a motor vehicle when your California driver's license was suspended or revoked; and
  • 2. You knew or should have known that your California driving privileges were suspended or revoked.

Drunk in Public and Public Intoxication

California's Drunk in Public or Public Intoxication statute can be charged as a misdemeanor, but the penalties may vary according to the reason you were arrested.

A violation of the Drunk in Public and Public Intoxication statute can yield to a maximum of six months in jail and is violated when:

  • 1. Your level of intoxication makes you unable to exercise reasonable care for yourself and those around you; or
  • 2. Your level of intoxication obstructs or interferes with others' ability to use streets, sidewalks, or other public ways.
